Terms of Service

These Terms of Service ("Terms") govern your use of the Amigens mobile application and website (the "Service") operated by Amigens ("we," "us," "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use Amigens. Users under 18 are not permitted to create an account or use the Service.

By using the Service, you represent and warrant that you meet these eligibility requirements. If we learn that a user under 18 has created an account, we will terminate access immediately and delete any associated data.

2. Account and Authentication

Amigens uses the AT Protocol (Bluesky) for authentication. You sign in with your existing Bluesky account credentials. You are responsible for:

Maintaining the confidentiality of your account credentials
All activity that occurs under your account
Notifying us immediately of any unauthorized use of your account

We do not store your password. Authentication is handled entirely by the AT Protocol.

3. Acceptable Use

You agree to use the Service only for lawful purposes. You agree not to:

Post, share, or transmit any content that is illegal under applicable law
Post child sexual abuse material (CSAM) or any content that sexually exploits minors
Engage in grooming, solicitation, or predatory behavior toward minors
Harass, bully, threaten, or intimidate other users
Post content that promotes hate or discrimination based on race, ethnicity, national origin, sex, gender identity, sexual orientation, religious affiliation, age, disability, or serious disease
Post non-consensual intimate imagery
Impersonate another person or entity
Engage in spam, phishing, or deceptive practices
Distribute malware, viruses, or other harmful code
Attempt to gain unauthorized access to the Service, other accounts, or computer systems
Circumvent, disable, or interfere with security or moderation features
Use the Service to violate the rights of others, including intellectual property rights
Use automated systems (bots, scrapers) to access the Service without our permission
Use the Service for any commercial purpose without our authorization

4. Content

4.1 Ownership

You retain all rights to the content you create through Amigens. Your content is stored on your Bluesky Personal Data Server (PDS) using the AT Protocol. We do not claim ownership of any user-generated content.

4.2 License

By posting content through the Service, you grant us a limited, non-exclusive, royalty-free license to cache, display, and distribute your content solely for the purpose of operating the Service (e.g., serving feeds, displaying posts to circle members).

4.3 Content Removal

You can delete your content at any time through the app. Deleted content will be removed from our cache within 24 hours. Content stored on your PDS is under your direct control.

5. Moderation and Enforcement

5.1 Reporting

Users can report content and accounts using the in-app reporting feature. Reports are submitted to Bluesky's moderation system via the AT Protocol (com.atproto.moderation.createReport).

5.2 Our Rights

We reserve the right to:

Remove content from our cache that violates these Terms
Suspend or terminate access to the Service for users who violate these Terms
Cooperate with law enforcement and report illegal content, including CSAM, to the appropriate authorities (including NCMEC)
Modify the Service at any time without notice

5.3 EU Digital Services Act (DSA) Transparency

In compliance with the EU Digital Services Act, we provide the following transparency information:

Content moderation: We rely on user reports and Bluesky's moderation infrastructure. We do not use automated content moderation systems.
Recommender systems: Feeds are displayed chronologically. We do not use algorithmic recommendation or personalization.
Advertising: We do not display advertisements.

6. Intellectual Property

The Service, including its design, code, logos, and trademarks, is owned by Amigens and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The Service will be uninterrupted, secure, or error-free
Content posted by users is accurate, reliable, or appropriate
The Service will meet your specific requirements
Any defects in the Service will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AMIGENS, ITS OPERATORS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

10. Indemnification

You agree to indemnify, defend, and hold harmless Amigens and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, or your violation of these Terms.

11. Dispute Resolution

11.1 Informal Resolution

Before filing a formal dispute, you agree to contact us at legal@amigens.com and attempt to resolve the dispute informally for at least 30 days.

11.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

11.3 Jurisdiction

Any disputes arising out of or relating to these Terms or the Service shall be resolved in the courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts.

11.4 EU Users

If you are an EU consumer, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence. You may also be entitled to bring a claim before the courts of your country of residence.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

Your right to use the Service ceases immediately
We may delete cached data associated with your account
Your posts remain on your Bluesky PDS (we have no control over them)
Provisions that by their nature should survive termination will survive, including Sections 8, 9, 10, 11

13. Changes to These Terms

We may revise these Terms at any time. Material changes will be communicated through the app or by updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Child Safety Policy, constitute the entire agreement between you and Amigens regarding the Service.
